Backpack Kid And More Have Sued Fortnite Over Their Signature Dance Moves

Backpack Kid’s mom filed the lawsuit on behalf of her 16-year-old kid, who posted videos of himself doing floss dance back in 2016.

Backpack Kid says he’s in the process of copyrighting the dance. Epic Games is sued for unspecified damages and Backpack Kid wants a judge to stop the companies from stealing his moves.

In an interview a few months ago at the Fortnite competition, he said he was excited his dance was in the game and that he was working on another one to hopefully be in the game. When people asked him if it bothers him for not getting paid, he said no and it was just cool to see it in a game.

They’re all being represented by the same law firm, Pierce Bainbridge Beck Price & Hecht LLP.

In intellectual property law, it is possible to copyright a dance, but not an individual dance move. The dance must have a series of movements that are arranged in a unique, original sequence in order to have copyright protection.
